Miscarriage Care in the ER

If you’re experiencing a miscarriage or pregnancy loss, you have the right to emergency care, no matter your ability to pay. Under federal law (EMTALA), emergency rooms must evaluate and stabilize you when you're experiencing an emergency medical condition, including complications from a miscarriage.

What to Do If You’re Denied Care:


1️⃣ Request Care Under EMTALA:

  • “I am requesting emergency care under EMTALA.”

  • “I am experiencing a pregnancy-related emergency, and I need immediate care.”

2️⃣ Ask for Documentation:

  • “Please provide a written explanation for why care is being delayed or denied.”

  • “Can I speak to the ER director or hospital administrator?”

3️⃣ Clearly State Your Symptoms:

  • “I am bleeding heavily.”

  • “I am in severe pain.”

  • “I have signs of infection (fever, chills).”

4️⃣ Document Everything:

  • Write down names, times, and statements made by staff.

  • Keep a record of the care you received or were denied.

Emergency Symptoms to Watch For:

  • Heavy bleeding soaking a pad within an hour.

  • Severe abdominal pain or cramping.

  • Fever or chills indicating infection.

Helpful Tip:
Hospitals cannot refuse to treat you based on the potential for miscarriage care to be viewed as an abortion. You have the right to medical care.
