Will a national abortion ban apply to me if I live in a blue state or a state that enshrined abortion into our state constitution?
If a national abortion ban were enacted, it will still impact you even in a state with strong protections for abortion. While states that enshrine abortion rights would likely challenge a ban, federal law typically overrides state laws, so courts would play a major role in deciding how this all unfolds.
Adding to the uncertainty is the Comstock Law—a 19th-century law that, if interpreted broadly, could restrict abortion access nationwide by limiting the shipment of abortion medications and supplies. This law could put abortion clinics at risk, even in states with protections, by making it harder for them to access necessary supplies.
The good news is that states with robust abortion protections are already preparing to defend these rights, and any changes would likely lead to spirited court challenges. But there will definitely be still be some bumps in the road while things get sorted out leading to gaps and inconsistency of care.
